Defective Product Claims Against Mirena

Mirena is a small plastic T- shaped IUD birth control device. Placed directly in the uterus, it releases a hormone that affects sperm movement. Mirena is advertised by its manufacturer to be over 99% effective with a lifetime of up to 5 years.

The FDA has received about 70,000 injury reports in relation to Miena use since the device was introduced in 2000. According to these reports, Mirena can cause organ perforation and it also can move around inside the body causing severe pain, bleeding, and other adverse health effects. These complications can occur months or even years after it is initially inserted.

Because the manufacturer failed to provide information concerning the lifespan of this device, many women thought it could be used indefinitely which increased the risk of side-effects. In addition, Bayer failed to advise that Mirena was primarily recommended for women who had had a child before and was allegedly negligent in providing warnings of the risks of use.

Mirena Litigation History

These failures on the part of the manufacturer led thousands of women to file lawsuits against Bayer. However, the lawsuits that claimed Mirena caused uterus perforation during application as well as those claiming device migration were dismissed by a federal judge in 2016 due to a lack of scientific evidence that could corroborate plaintiffs claims.

Current Active Lawsuits

Nevertheless, there are currently more than 500 active lawsuits involving women who have used Mirena claiming they suffered injuries due to a condition called pseudotumor cerebri. This condition is caused by increased blood pressure in the brain with symptoms similar to a brain tumor. Pseudotumor cerebri can lead to brain damage and injuries such as vision loss, damage to the optic nerve, migraines or tinnitus. In some cases, a brain surgery may be necessary to treat the condition. Current lawsuits allege that Bayer has been negligent in providing a warning about these risks.
